Please read these Terms and Conditions carefully before using TheEcomWay platform. These terms constitute a legally binding agreement between you and TheEcomWay governing your use of our marketplace reconciliation services.

1. Acceptance of Terms

  • By accessing or using TheEcomWay's platform, you agree to be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.
  • These Terms apply to all visitors, users, and others who access or use our service, including free users, paid subscribers, and API users.

2. Description of Services

  • TheEcomWay provides a cloud-based marketplace reconciliation platform that helps Indian e-commerce sellers reconcile settlement data from Amazon, Flipkart, and Meesho.
  • Our services include automated reconciliation reports, shortfall detection, reimbursement tracking, profit/loss analysis, and related seller tools.
  • We reserve the right to modify, suspend, or discontinue any part of our services at any time with reasonable notice.

3. Account Registration & Security

  • You must provide accurate, complete, and current information when registering for an account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You must notify us immediately at support@theecomway.com of any unauthorized access to or use of your account.
  • We reserve the right to terminate accounts that violate these terms or engage in fraudulent activity.

4. Subscription & Payment Terms

  • Paid subscriptions are billed in advance under the 2-Week, Quarterly, or Yearly plan you select. All prices are in Indian Rupees (INR) and inclusive of applicable taxes.
  • Subscription fees are non-refundable except as provided under our 14-Day Money-Back Guarantee policy, which applies exclusively to the 2-Week Plan. Quarterly and Yearly plans are non-refundable once purchased.
  • Failure to pay subscription fees may result in suspension or termination of your account.
  • We reserve the right to change pricing with 30 days' prior notice to existing subscribers.

5. Acceptable Use

  • You agree to use our platform only for lawful purposes and in accordance with these Terms.
  • You may not use our service to upload malicious files, attempt unauthorized access, engage in data scraping, or reverse-engineer our software.
  • You may not share your account credentials with others or allow multiple users to use a single-user subscription.
  • Commercial resale or redistribution of our reconciliation reports without written consent is strictly prohibited.

6. Intellectual Property

  • The platform, including its software, design, algorithms, and content, is owned exclusively by TheEcomWay and is protected by applicable intellectual property laws.
  • Your reconciliation data and reports generated from your uploaded files remain your property.
  • You grant us a limited license to process your data solely for the purpose of delivering our services.

7. Data Accuracy & Disclaimer

  • Our reconciliation reports are generated based on the data you upload. Accuracy depends entirely on the completeness and quality of the input data.
  • TheEcomWay does not guarantee the accuracy, completeness, or timeliness of reconciliation reports. Always verify critical financial decisions with your accountant or marketplace directly.
  • We are not liable for any financial loss arising from reliance on our reconciliation reports.

8. Limitation of Liability

  • To the maximum extent permitted by law, TheEcomWay shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
  • Our total liability to you for any claims arising under these Terms shall not exceed the amount paid by you to us in the 3 months preceding the claim.

9. Termination

  • You may cancel your subscription at any time through your account settings or by contacting support@theecomway.com.
  • We may terminate or suspend your account immediately, without prior notice, for conduct that we determine violates these Terms.
  • Upon termination, your right to use the service will immediately cease. We may delete your data 60 days after account termination.

10. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of India.
  • Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana.

11. Changes to Terms

  • We reserve the right to update these Terms at any time. We will notify users of material changes via email or in-app notification.
  • Your continued use of the platform after any changes constitutes your acceptance of the revised Terms.
